I would like to take this opportunity to wish everyone Happy Independence Day. God Bless America.

On behalf of Mission Members, congratulations to James Houston, EA for becoming CSEA, Finance & Budget Committee Chairperson and to Margaret Dunn, EA for becoming PEPCO Committee Chairperson .

Last June, I attended CSEA 33rd Annual Meeting  at the Double Tree Hotel in Sonoma Wine Country.  CSEA awarded Chapter of the Year to Channel Islands Chapter and EA of the Year to Greg Cash, EA.  

MSEA was one of the last two finalists for Chapter of the Year and our members should be proud of the 2009-2010 MSEA Team Work. Let's make an extra effort to win the award next year.

IRS is considering changes to Circular 230 regarding Continuing Education requirements and EA designation. IRS may or may not change the Enrolled Agent Designation name.  During the Town Hall meeting, CSEA asked suggestions from members regarding EA Designation name change.

The upcoming PIN registration requirements will include ALL 2010 Tax Preparers either by re-registering their old PIN or getting a new PIN starting on
September 1, 2010.  

Current preparers who already have a PIN may re-register using eServices on the IRS.gov website when the requirement becomes effective. For more information, visit IRS and NAEA website.

Mission Education Committee under Myra Thompson, EA  planned great Education Topics for Mini Workshops and Full Day Seminar next month to meet Continuing Education needs. I will encourage all members to support MSEA Education Team.  

I would like to further encourage and invite all members to come watch the MSEA Board meetings every 3rd Tuesday of the month, this month on July 20, 2010. Be a Member of MSEA Team.

 What did I learn recently? 
 
The IRS may start assessing a failure to file penalty even if the taxpayer filed an extension. This will most likely be during an audit and the 25% failure to file penalty will be in addition to any 20% substantial understatement penalty. For example, when a taxpayer has reason to know that they will have a tax liability, has no estimated payments or withholding and, on the application for an automatic extension of time to file, enters "zero" for the tentative tax liability, the Service may invalidate the extension and apply the FTF penalty from the return due date. See Rev. Rul. 79-113, 1979-1 C.B. 389. Do not be fooled by thinking that even if the extension includes a payment it is safe. If the estimate is not considered to be close to a realistic attempt to calculate the tax due the FTF, may and will come up. In Crocker V Commissioner 92TC 899 (1989) in 1981 the TP filed an extension and paid $8,000 the tax liability (prior to audit) was $41,559 the subsequent year they underestimated their liability by approximately $27,000. In his opinion the judge writes "In order to avoid the addition to tax under section 6651(a)(1), a taxpayer must show both reasonable cause and a lack of willful neglect.
